I Remarried My Ex-Husband Recently. What are My Rights to the Town Home We Now Live in?

Question:

When we divorced early this year he bought me out of the town home that was purchased during our first marriage because I didn’t have money to buy him out. If a second divorce should happen God forbid what are my rights, can he put me out?


Answer:

If there is a second divorce, the court would look at the value of the town home on the date of the second marriage (since he bought you out of your interest that accrued during the first marriage) and any increase in value/equity from the date of the second marriage to the date of the second divorce would be considered marital. At the point of the second divorce, you would then see if you could buy him out.
