Contributing Factors to Alimony

When a couple goes through a divorce in Massachusetts, it is important that they address a number of different matters before they can finalize the divorce and effectively end the marriage. One of the most highly contested matters that may need to be addressed in a divorce is that of alimony. Alimony is when one spouse is ordered to pay support to another spouse after the marriage is over. When one spouse is financially dependent on the other during the marriage, it can be difficult for the dependent spouse to get back on their feet after the divorce. It is important to note that alimony is not necessary in every divorce because, in a lot of cases, both spouses are financially independent of one another.

There are many different factors that are considered when it comes to alimony. One of the biggest factors that is considered in determining an alimony award is the length of the marriage. When the court awards a general term alimony award, the length of the alimony obligation directly correlates with the length of the marriage. For example, if a marriage lasted less than 10 years, the alimony obligation can’t last longer than 60 percent of the length of the marriage.
