Types of Custody Awarded in Massachusetts
In Massachusetts, there are two main types of custody awarded to parents:
Physical custody: This is awarded to the parent with whom the child spends the most time. Often, parents work together to share physical custody. Legal custody: This refers to a parent’s legal right to make important decisions in the life of the child. These decisions may regard choices about the child’s academics, religion, and health care. Normally, legal custody is awarded to both parents.
If you have sole legal custody, it is up to you whether you vaccinate your child. But, if you and your ex share legal custody, you will have to be in agreement.

If you and your ex cannot agree to vaccinate your child, you should make sure to speak with your child’s pediatrician. This will help you make a fully informed decision. If you are still not in agreement, the objecting spouse can request mediation. This involves a neutral third party helping you work through the matter at hand. If mediation does not solve the problem, you will likely need the help of a Massachusetts family court. In this case, a judge will work to make the decision that is in your child’s best interests.
